These Terms of Service ("Terms") govern your access to and use of the Sofaine online store at sofaine.com (the "Store") and every purchase you make through it. Please read them before ordering: placing an order means you accept them.
1. Who we are

2. Acceptance of these Terms
By visiting the Store, creating an account, or purchasing something from us, you agree to be bound by these Terms, including the policies referenced in them: the Shipping Policy, Refund Policy, Privacy Policy, and Payment Policy. If you do not agree with any part of these Terms, please do not use the Store.
3. Eligibility
You must be at least 18 years old, or the age of majority in your state of residence, to make a purchase. By ordering, you represent that you meet this requirement and that the information you provide is accurate and complete.
4. Products and product information
We take care to display our products accurately, including materials (e.g. vegan leather is always described as vegan leather) and colors. Slight variations can occur due to screen settings and photography lighting. We reserve the right to limit quantities, discontinue products, and correct errors in descriptions at any time; if an error affects an order you have already placed, we will contact you before proceeding.
5. Prices and payment
All prices are shown in US dollars (USD). Shipping on US orders is free; any applicable sales tax is calculated and shown at checkout before you confirm your order. We accept the payment methods listed in our Payment Policy. Payment is due at the time of order. We reserve the right to correct pricing errors; if a product's correct price is higher than stated at the time of your order, we will contact you for instructions or cancel the order and refund you in full.
6. Order acceptance and cancellation by us
Your order is an offer to purchase. A contract is formed when we send you the order confirmation. We may refuse or cancel an order in cases of suspected fraud, pricing or stock errors, or inability to verify billing information. If we do, any amount already charged is refunded in full without delay.
7. Shipping and delivery
Delivery timelines, order processing, tracking, customs, and our 30-day shipment commitment are set out in the Shipping Policy, which forms part of these Terms. In short: orders are processed within up to 48 hours and delivered within 6–10 business days of dispatch, with tracking emailed for every order.
8. Returns and refunds
You may return items within 30 days of delivery as set out in the Refund Policy, which also contains the statutory withdrawal information and the model withdrawal form. Returns require prior authorization (RMA), so please contact us before sending anything back.
9. Accounts and accuracy of information
If you create an account, you are responsible for keeping your login credentials confidential and for all activity under your account. You agree to provide current, complete, and accurate purchase and account information and to promptly update it as needed so that we can complete your transactions and contact you.
10. Prohibited uses
You may not use the Store: for any unlawful purpose; to solicit others to perform unlawful acts; to violate any regulations or laws; to infringe our or others' intellectual-property rights; to harass, abuse, or discriminate; to submit false or misleading information; to upload malicious code; to collect or track the personal information of others; to spam, phish, or scrape; or to interfere with the security features of the Store. We may terminate your use of the Store for violating any prohibited use.
11. Intellectual property
All content on the Store (text, graphics, logos, images, and their arrangement) is the property of Sofaine or its licensors and is protected by copyright and trademark law. You may not reproduce, duplicate, copy, sell, or exploit any portion of the Store without our express written permission.
12. Third-party links and tools
The Store may include links to third-party websites or use third-party tools (for example, our order-tracking service). We are not responsible for the content or accuracy of third-party sites and provide access to such tools "as is" without warranties. Complaints or questions regarding third-party sites should be directed to the third party.
13. Disclaimer of warranties
We do not guarantee that your use of the Store will be uninterrupted, timely, or error-free. Except as expressly stated in these Terms or required by law, the Store and all products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow the exclusion of implied warranties; in that case, the above exclusions apply to the fullest extent permitted by law.
14. Limitation of liability
To the fullest extent permitted by law, Sofaine and its owner shall not be liable for any indirect, incidental, punitive, special, or consequential damages arising from your use of the Store or any product, including lost profits or lost data. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim. Nothing in these Terms limits liability for intent, gross negligence, injury to life, body, or health, or any liability that cannot be excluded by law. Some states do not allow limitations on incidental or consequential damages; in such states, our liability is limited to the maximum extent permitted by law.
15. Indemnification
You agree to indemnify and hold harmless Sofaine and its owner from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.
16. Severability
If any provision of these Terms is held to be unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the remaining provisions remain in full force and effect.
17. Governing law and your local rights
These Terms and any purchase through the Store are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer in the United States, this choice of law does not deprive you of the protection of mandatory consumer-protection provisions of the state in which you reside. Those rights remain fully yours.
18. Changes to these Terms
We may update these Terms from time to time. The current version is always available on this page with its effective date; changes apply to orders placed after the change is published. Your continued use of the Store after changes are posted constitutes acceptance of the revised Terms.
19. Entire agreement
These Terms, together with the policies referenced in them, constitute the entire agreement between you and Sofaine regarding the Store and supersede any prior agreements or communications on that subject.
